RERA Gujarat (GUJRERA) 2024: Everything You Need To Know

Gujarat RERA (Real Estate Regulatory Authority) is a regulatory body that was established in Gujarat, India in 2016, under the Real Estate (Regulation and Development) Act (RERA) of 2016. RERA Gujarat’s main objective is to regulate and promote the real estate sector in the state, by ensuring transparency, accountability, and efficiency in the sale and purchase of real estate properties. This article covers every detail you need to know about RERA Act Gujarat.

What Is RERA Gujarat And Its Primary Goals?

The Gujarat RERA serves many purposes, such as:

  • Getting real estate projects and agents registered and giving them each a unique registration number.
  • Getting complaints from homebuyers about builders and developers and figuring out how to fix them.
  • Making sure that real estate projects are finished on time and according to the plans and specifications that have been approved.
  • Having builders and developers put a certain amount of the cost of a project in a separate escrow account to make sure that the money is only used for what it was meant for.
  • Real estate agents' actions are watched over and regulated to stop fraud and misrepresentation.
  • Giving information about registered real estate projects and agents to homebuyers and other people who have an interest in them.

Benefits Of Registering With RERA Gujarat

Project Registration: RERA Gujarat requires all residential and commercial real estate projects to be registered with the state RERA authority before they can be sold or advertised. The project's promoter must provide plans, financing, land ownership documentation, approvals, and timelines during registration.

Timely Delivery: GUJRERA requires real estate promoters to finish projects on the date they agreed to. If the promoter doesn't finish on time, they may have to pay fines and refund buyers.

Escrow Account: The Real Estate Regulation Act (RERA) requires real estate promoters to deposit 70% of buyer funds in a project-specific escrow account. The promoter must update buyers on project progress and use these monies only for building and development.

Contract Standardization: RERA standardized the promoter-buyer agreement. This agreement describes the project, construction timeline, buyer takeover date, and other facts. This avoids all cases of fraud or misunderstanding. Real estate brokers must disclose the project's promoter, schedule, approvals, and other pertinent information. Agents cannot lie about the project or property.

Grievance Redressal Mechanism: Homebuyers can complain to GUJRERA regarding the project. They now know who to turn to in times of need.

A promoter has to register on the Gujarat RERA website using his or her email and mobile number as well as basic identification documents, thereafter they can register their project after due verification by the Gujarat RERA officials. The Gujarat RERA Registration process consists of uploading the basic details of the promoters, the project, technical details, financial details, legal details as well as certification of the same by professionals including architect, engineer, and a chartered accountant.

How To Register Under Gujarat RERA

Real estate agents must register with their state's RERA administration. Agents must enter their PAN, Aadhaar, and other information and acquire a registration number, which must be quoted in all transactions. You will be required to pay a certain amount of GUJRERA fees and charges. To check whether your project is registered, log on to www.gujrera.gujarat.gov.in and look up your registration. You can click on the Advanced Search option to look for exact details like status and project specifications.

Documents Required

The promoter has to upload all the major documents related to the scheme on the Gujarat RERA website which can be viewed freely by the buyers. This allows them to be independent in their decision making and not reliant on the builder to provide them vital information.

Documents required by promoter are:

  • Company registration certificate
  • Photograph of promoter and project head
  • Project completion certificate
  • NOC (Form-1A)
  • Auditor report
  • ITR
  • PAN card
  • Encumbrance and Commencement certificates
  • Approved building plan/plotting plan, layout plan, and area development plan
  • Sale agreement
  • Declaration (Form B)
  • 7/12 document
  • Title report and clearance certificate
  • Engineer certificate (Form 2)
  • CA certificate (Form 3)
  • Balance sheet and P&L statements of past 3 years
  • Directors’ report (for 3 years)

Documents required by agent are:

  • Details of enterprise, i.e., name, registered office address, and type of company.
  • Memorandum of association.
  • Document defining proprietorship or partnership.
  • Real estate agent name, address, and contact details.
  • PAN card.

All the details provided by the builder have been scrutinized by subject experts which provides further confidence to the buyers and helps in establishing a relationship of trust between the buyers and the sellers. The buyer can complain as an individual or as an association through RERA Gujarat complaint mechanism regarding a project or promoter in case of any discrepancy or if the promoter is not delivering as promised.

Conclusion

Gujarat RERA has helped bring transparency and accountability to the real estate sector in Gujarat, and has provided a platform for homebuyers to voice their concerns and seek redressal of grievances.
